Regulate, Don't Eliminate: What the Barr Bill Could Mean for Hemp and Moon Flower

The federal hemp landscape has been changing rapidly over the past several months. Between proposed legislation, political debates, industry rumors, and regulatory uncertainty, it has been difficult to provide updates with confidence.
However, after recent discussions involving the Hemp Industries Freedom Alliance (HIFA), Congressman Andy Barr, and Senator Ted Cruz, we finally have enough information to paint a clearer picture of where things may be heading. While there is still uncertainty, one thing is becoming increasingly clear:
The conversation in Washington is no longer focused on whether hemp should exist. The conversation is shifting toward how hemp should be regulated moving forward.
For our industry, that's a significant change.

Who Is Andy Barr and Why Does His Bill Matter?
Congressman Andy Barr of Kentucky is currently running for a U.S. Senate seat and
has emerged as one of the strongest advocates for replacing the proposed November hemp ban with a federal regulatory framework.
While the "Barr Bill" has not yet been officially introduced, discussions with industry stakeholders and comments from Congressman Barr suggest the legislation may include:
A permanent legal pathway for hemp-derived cannabinoid products
Federal age restrictions (likely 21+)
Enhanced testing and product safety requirements
Restrictions on marketing products to children
Federal oversight and regulation
A federal tax structure for hemp-derived products
Long-term industry stability instead of prohibition
The goal appears to be regulation rather than elimination.
What Could Happen to Hemp Beverages?
One of the most important discussions surrounding the Barr Bill involves hemp beverages.
Based on information currently available, hemp beverages could eventually be regulated under a three-tier alcohol-style distribution system. For consumers, this would likely mean a slight change in product availability. For companies like Moon Flower, however, it would represent a significant shift in how products reach the market.
Under a three-tier model, hemp beverages would move through licensed alcohol distributors and wholesalers before reaching retailers.
This could potentially eliminate:
Direct-to-consumer online beverage sales
Direct in-store beverage sales at Moon Flower locations
Certain direct retail relationships
Instead, products would follow a distribution structure similar to beer and alcohol.
While this is not our preferred outcome, it is important to understand the distinction between regulation and prohibition.
Moon Brews would still exist.
Consumers would still have access. Just slightly more limited.
The path from our facility to your hands would simply look different. As a company, we are already exploring ways to strengthen distribution relationships and prepare for a future where beverages may operate within a more traditional alcohol-style framework.
What Is Senator Ted Cruz Saying?
Recently, Senator Ted Cruz participated in discussions with industry leaders regarding the future of hemp. Cruz has been one of the few Republican senators willing to publicly oppose broad federal hemp prohibition. His position has consistently emphasized allowing individual states to determine hemp policy rather than imposing blanket federal bans.
He has repeatedly expressed support for:
Protecting children
Eliminating unsafe products
Preventing dangerous foreign imports
Allowing responsible businesses to continue operating
Perhaps most importantly, Cruz acknowledged that the industry provides significant economic benefits for farmers, veterans, small businesses, and consumers throughout the country.

However, he also identified the industry's biggest challenge.
While he believes Congressman Barr's legislation would likely receive strong support in the House of Representatives, he noted that the Senate remains heavily influenced by Senator Mitch McConnell's position on hemp. This means the path forward remains uncertain, even as support for regulation continues to grow.
What We Still Don't Know
There are still several major questions that remain unanswered.
We do not yet know:
The final language of the Barr Bill
How hemp beverages will ultimately be regulated
What future tax structures may look like
Whether cannabinoid limits will be imposed
Whether Congress will pass comprehensive legislation before November
Whether another extension may be required
The reality is that nobody has all the answers right now.
What This Means for Moon Flower
As we evaluate the direction of federal regulation, you should expect some changes from Moon Flower over the coming months. Some changes may be visible to customers, while others may happen behind the scenes.
You may see:
New product formulations
Certain product and product Line discontinuations
Increased focus on wellness-focused cannabinoids
Adjustments to serving sizes or potency options
Strategic shifts in distribution methods
New product launches designed to strengthen our portfolio
These decisions are not being made because we want to change what has made Moon Flower successful. We just understand that the companies that survive regulatory change are the companies that prepare before the regulations arrive.
That's exactly what we're doing.
Our Commitment Remains the Same
While the future may look different than it does today, our mission remains unchanged. We will continue advocating for responsible hemp regulation. We will continue fighting for consumer access. And we will continue providing natural alternatives and healthier ways to relax, recover, and socialize.
We aren't thrilled about the uncertainty and aren't excited about potential regulatory burdens. But if the rules change, we will adapt. If new standards are created, we will meet them. And if new challenges arise, we will continue finding new ways to serve the Moon Flower community.
